Description

A use of force incident is not fully evaluated by what occurred on the street—it is evaluated by how accurately and effectively the officer documents the event. A well-written report provides the factual foundation for meaningful reviews, criminal investigations, civil litigation, and public accountability. Even a legally justified use of force can be called into question when an officer fails to properly articulate the facts, perceptions, and decision-making that led to the application of force.

Words Matter: Writing Defensible Use of Force Reports is an intensive, practical course designed to teach officers how to document use of force incidents in a manner that is clear, complete, accurate, and legally defensible. Moving beyond report-writing basics, this course focuses on the critical importance of articulation—explaining not only what force was used, but why it was objectively reasonable under the totality of the circumstances.

Through the analysis of real use of force reports, body-worn camera footage, surveillance video, and actual case studies, participants will learn how investigators, prosecutors, internal affairs investigators, attorneys, and juries evaluate force reports. Students will identify common reporting deficiencies, recognize language that creates unnecessary liability, and develop techniques for accurately documenting observations, threat assessments, subject behavior, officer perceptions, tactical considerations, and post-force actions.

The course also examines how stress, memory, perception, and human performance influence an officer's ability to recall and document critical events. Participants will learn practical methods for organizing information, accurately describing rapidly evolving incidents, and articulating force decisions in a manner consistent with constitutional standards, agency policy, and accepted law enforcement practices.

By the conclusion of this course, officers will have the confidence and skills necessary to prepare reports that accurately reflect the facts, withstand administrative and legal scrutiny, and clearly demonstrate the objective reasonableness of their actions.
